These Terms of Service ("Terms") govern your use of Brainko LTD's learning platform (the "Service") on www.brainko.com and institution sub-domains. By accessing or using the Service, you agree to these Terms.
If your account is provided by an educational institution ("Institution"), your Institution's policies may also apply.
You must provide accurate account information and keep your login credentials secure. You are responsible for activity under your account unless caused by our security failure.
Institutions are responsible for configuring accounts, permissions, and applicable notices/consents for their users, including students.
Authorized institution staff may access student and class information according to institutional settings and policies.
You may not misuse the Service, including by uploading unlawful content, infringing intellectual property rights, attempting unauthorized access, disrupting system security, reverse engineering the platform except as permitted by law, or scraping/re-selling the Service without written permission.
You retain ownership of content you submit. You grant us a non-exclusive license to host, process, copy, and display that content only as needed to operate, secure, and improve the Service.
The Service software, code, design, and branding are owned by Brainko or its licensors and are protected by applicable law.
Some features use third-party AI services (for example, question-generation). By using those features, you authorize processing needed to provide them and confirm you have rights to submit the related content.
AI outputs and automated scans can contain errors and should be reviewed by teachers or administrators before relying on them for grading or educational decisions.
Our processing of personal data is described in our Privacy Policy and Cookie Policy, which form an integral part of these Terms.
We may update features, add or remove functionality, and perform maintenance from time to time. We do not guarantee uninterrupted or error-free operation.
We may suspend or terminate access if these Terms are violated, if required by law, or to protect users and the Service.
You may stop using the Service at any time. Account deletion options are available through account settings or via support.
The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim warranties not expressly stated in these Terms.
To the maximum extent permitted by law, Brainko and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities arising from use of the Service.
These Terms are governed by the laws of Israel, without regard to conflict-of-law rules, and disputes will be subject to the competent courts in Israel, unless mandatory law requires otherwise.
We may update these Terms from time to time. Continued use of the Service after the updated effective date means you accept the revised Terms.
